Warrants PDF Print E-mail

An arrest warrant is a document issued most often by a judicial official, ordering a law enforcement officer to arrest the person named in the warrant and bring said person before the court or a magistrate. A criminal arrest warrant must be issued based upon probable cause, but not all arrests require an arrest warrant.

A bench warrant is a type of arrest warrant issued by a judge for the arrest of an individual who is indicted or in contempt of court.

Warrants are issued (and cancelled) based on information. With so many warrants issued in New York, many are improper because important information was not provided to the police (or the judge) to extinguish the warrant.

If a warrant is properly issued, an attorney can help arrange for a voluntary surrender, also know as a voluntary return on a warrant. This will greatly benefit the client with regard to bail issues and the case’s ultimate disposition.
