Approximately 97% of the cases charged in New York do not go to trial. Most cases are either dismissed or result in a plea after the attorney negotiates a disposition with the office of the district attorney, known as “plea bargaining.:” An experienced criminal defense attorney should always keep both avenues in mind throughout the course of the representation.
